OptiYard.ai (optiyard.ai)
- OptiYard.ai is a website for members and general site visitors.
- The company utilizes third party (remote) servers to retain its data and all website related functionality, including backup protocols. Tansect, Inc. outsources the hosting (including OptiYard.ai), management of the site as it relates to hosting, databases, email and other IT functionalites to a third party (GoDaddy).
- Use of a third party permits Tansect to utilize their economies of scale, expertise and network in an attempt to maximize the sites performance and security.
- OptiYard.ai does not offer a Do Not Track request option. Users that do not agree to this policy should not create an online profile within the OptiYard.ai platform.
PAYMENT & REFUND POLICY
- Optiyard.ai is a platform that offers both free services and paid options.
- Discounted rates are available to users that renew prior to 90 days of their plan's expiration.
- These conditions apply whether user secures a "discounted rate" for early renewal, or if customer paid "full price".
- Tansect reserves the right to offer new plans and pricing, and cancel existing plans, as business dictates.
- Users with paid plans that get discountinued will have their existing pricing and functionality honored until the expiration date of their existing plan.
- OptiYard does not announce plan changes, or new plans, prior to their posting on the site.
- Users that purchased a plan on a previous date may not receive refunds or plan changes (excluding the terms on this page) if a new plan, or reduced price, becomes available after their purchase. Exceptions are made at the discretion of OptiYard.ai.
- If user has a "free plan" and upgrades, that upgrade will be active for 365 days...and will extend 365 days with each renewal (if existing plan exists) and/or upgrade.
- If user upgrades from current plan, their expiration is extended 365 days from original expiration...and their plan immediately upgrades, regardless of original expiration
- If user downgrades, the downgrade will become effective at the original expiration date, and the new plan will become effective for 365 days from the original expiration date.
- If a plan expires without renewal, it will default to the "FREE" plan.
- If a plan downgrades, user is encouraged to remove yard spots and users to meet your new plan's parameters... prior to expiration. Otherwise, OptiYard reserves the right to set their account to default options of new plan...which may not match the user's needs/expectations
- THERE IS NOT A REFUND OPTION, even if downgrading. Downgrades and changes will be reflected at the end of the original expiration date.
- Users of the "FREE" plan idemnifies Tansect, Inc and OptiYard of all damages created by downtime or other operational interuptions.
- Tansect reserves the right to terminate all OptiYard.ai functions operations upon the expiration date of a paid user's existing plan.
- Tansect reserves the right to terminate all OptiYard.ai funcations and operations for any free plan with 30 days notice.
- Location Admins/Moderators manage the users of their locations directly and can terminate, or add, users as their plan and/or operation needs.
PRIVACY POLICY
- Tansect, Inc. DOES NOT sell user specific PII to third parties, and only uses it for internal purposes.
- Using OptiYard.ai you are giving Tansect, Inc. the right to release collective data to report trends where your data is compiled along with other members (# members with plans to XYZ, # users on the site for a paricular day, # of members, etc.).
- Tansect may get requests for account information from law enforcement authorities like the police or for use in courts. These requests may require the release of user related information, including PII.
- Tansect does not retain personal information from general site visitors within its databases. Some information is collected from all site visitors that does not reside in our databases:

- Submitting PII through our website is voluntary. The only information that is required to become a member are a unique email address and a password. Other information shared and retained includes, but may not be limted to: name, address, and phone number.
- Tansect may use email addresses to send messages to a user regarding their account or changes to this policy.
- Other PII can be supplied by users as they use various functions within the site.
- Users that do not agree to this policy should not create an online profile within the OptiYard.ai platform.
- For each user OptiYard.ai logs their activities within the site, and makes certain aspects visible to other users within their shared accounts.
- Tansect utilizes third party processors to conduct credt card transactions.
- Currently all transactions are handled by PayPal.
- Those credit card transactions are conducted on those party's sites and all terms, conditions and policies for those sites apply to the transactions being conducted.
- Transitons to these pages are very clear to the user and they do not utilize the same formatting as OptiYard.ai.
- Tansect does not retain (digitally or written) any credit card information of our customers, members, users or visitors.
- We collect and temporarily store certain information about a visit for use in site management and security purposes only. We collect and analyze this information because it helps us to better design our website to suit the user's needs.
- Tansect does utilize analytics programs, currently Matomo, as well as "share" buttons. These applications may utilize cookies and users utilize the website with the undersanding that these items are in use.
- Though the data is not stored by Tansect, analytic programs collect data including, but not limited to:
